Subject:  Opposition Letter to Multifamily Development TDHCA Application:  13203 – Region 5 / Urban – “Providence On Major”

Attn: Ms. Jean Latsha and others associated with the Multifamily Finance Division:

Ms. Latsha,

As President of the Fairfield Home Owners Association, I am writing as the Association Representative to express our opposition to the funding and development of the multifamily development known as “Providence On Major” – Reference TDHCA Application: 13203.

The residents of several neighborhood associations are opposed to this project and some have elected to express their rights to protest in opposition.  This letter represents the residents of the Fairfield Subdivision that are in opposition.

Geographically, the Fairfield Subdivision is located directly across Major Drive from the proposed development sight for “Providence On Major” Multifamily Complex.  (Referenced Site Map Included)

I cannot speak to why each individual is in opposition, I can only speak to the fact that the overwhelming majority of our residents are in opposition.

The Fairfield addition has 88 properties in which 82 of these properties (93%)  signed a petition against any development of Multifamily Complexes on North Major Drive between Delaware and Folsom.

The following History is included in the E-mail attachment for supporting our opposition.

On February 14, 2013, the Fairfield HOA submitted to the Mayor of the City of Beaumont, all Council Members – City of Beaumont, County Judge – Jefferson County, all County Commissioners – Jefferson County, State Senator District 4, and State Representatives for both District 21 and District 22 our petition in opposition to any Multifamily Complex Developments in the fore mentioned corridor.

On February 19, 2013, County Judge Jeff Branick responded to the Fairfield HOA E-Mail with questions that required an appropriate response.

On February 19, 2013, I responded back to Judge Branick with a response to his questions.

On February 19, 2013, Judge Branick responded back indicating that one of the questions he had asked during a session with the developer was “how the neighbors feel about the proposal”.  Judge Branick then advised that we could discuss our concerns over the telephone.

Sometime during the week of February 22nd, I personally spoke to Judge Branick and discussed the concerns of the residents and their general feelings of opposition.

During our conversation, I was advised by Judge Branick that he had instructed the developers to meet with the residents concerning the development.

May 29, 2013, I advised Judge Branick that after 90 plus days, the developer has never contacted me or the HOA to discuss or even present the development plans or obtain any concerns that the residents may have.

I am extremely disappointed both personally and as the Fairfield HOA President that the developer did not take the time to contact or even appear to make an effort to meet with the residents of Fairfield over their concerns.

His actions or should I say lack of action indicates to myself that the developer could care less what the residents of those that will be living around this complex has to say.

As noted in the E-Mail, I advised Judge Branick that Fairfield would be sending this Letter of Opposition on or before June 1st, however, due to timing issues, it will be mailed during the week of June 3rd.

In addition, the Fairfield residents realize that the current location is within County jurisdiction and not the City of Beaumont; as such, it is understood that there are no zoning restrictions for development in the unincorporated areas of Jefferson County.

This leads to further concerns by the residents and that there will most likely be the need for the City of Beaumont to annex the property to provide the basic services such as:

  • Water
  • Sewer
  • Fire Protection
  • Police Protection

With the need for these services, the Fairfield residents, whom are residents of Beaumont, ask, who will fund the increase in the tax base needed to accommodate a planned 128 Units (as noted in the Application).

In conclusion, I request that the Fairfield Residents Letter of Opposition be entered into record as documentation against the funding of project TDHCA Application – 13203 – Region 5 / Urban – “Providence On Major”.

To support this request the following Documents are included:

  • Fairfield Subdivision Petition Collected in Opposition of Multifamily Complex’s
  • E-Mail Correspondence ( Fairfield HOA Subdivision to  Elected Officials of the City, County and State / Judge Branick to Fairfield HOA  Subdivision / R. Jones to Judge Branick / Judge Branick to R. Jones / R. Jones to Judge Branick
  • Map of “Providence On Major” in correlation to Fairfield Subdivision and Westchase Village (Map was taken from Application 13203 page 22 of 206 / Section – “Supporting Documentation for the Site Information Form”)

Should you have any questions or concerns please feel free to contact myself at the address below.

Respectfully Remaining,

Fairfield Subdivision HOA

05/28/2013 – Letter to Residents

Fairfield Residents,

As most of you are aware, the initial Multi-Family Tax Credit Program Complex, “Westfield Crossing” which was being planned to be built in front of Westchase Village will not proceed forward.

The development company dropped their plans to proceed after meeting the sever opposition from the residents of Westchase Village, Fairfield, and Barrington.

You may also remember that the initial petition was changed to address another development that was in the planning phases to go on County Property directly across from Fairfield next to Boys Haven.

This particular Project “Providence on Major Drive” is current proceeding forward with some community support from various Churches and Community Organizations.

The complex is shown to be a three (3) story complex is 128 Units divided by Rent Type as follows:

11 Low Income Units (TC 30%)

22 Low Income Units (TC 50%)

75 Low Income Units (TC 60%)

20 Market Rate Units

The State has advanced this application to the next phase which will be a review for funding.  The total funds being requested for the entire State is approximately $126 Million in which an approximately $ 58 Million is available.

The Project for our area (Region 5 / Urban) is requesting Tax Credits of $1.245 Million where there is only $ 830 Thousand available.

Please note that just because there is not enough money at this immediate time, as the State reviews the viable projects, the funds for this project may be transferred from other regions to fund this one based on many considerations.

As the President of the Fairfield Homeowners Association, I will be sending a letter with copies of our Petition to the Texas Department of Housing and Community Affairs – Multifamily Finance Division in opposition of this development proceeding.

I strongly urge each resident that is opposed to write as well stressing your opposition.

Note: Opposition Letters must be received by the State no later than June 14, 2013.

Please address your letter to the following:

Subject:  Opposition to Multi-Family Zoning on North Major Drive between Delaware and Folsom

The attached Petition is being preliminary submitted to inform each of you that the majority of the residences of the Fairfield Addition are expressing their opposition to have any land located on North Major drive between Delaware and Folsom rezoned to Multi-Family Zoning.

A copy of the Petition will be submitted to Planning and Zoning once the tract(s) are placed on the Agenda for Public Comments.

Currently the residents of Fairfield and other Subdivisions in the close proximity to Fairfield are being advised of two (2) Projects that have pre-applications already submitted to Texas Department of Housing & Community Affairs for development utilizing the 2013 Competitive Housing Tax Credit Pre-Application Certificate.

The pre-applications currently on file are:

  •        Westfield Crossing – Pre-Application Number 13179
  •        Providence on Major – Pre-Application Number 13203

At this time the Fairfield Petition (PDF Attached) has 82 of 88 properties in opposition (93%) that resides in the Fairfield Subdivision.

Furthermore, be it known that the Fairfield Residents that specifically received a notice of an informational meeting for Westfield Crossing by the developer, which was held on Tuesday, February 5, 2013 have each signed the Petition in opposition.

We will continue to collect signatures of opposition up until the time a zoning change is placed on the agenda for Public Comment.  We are also aware that the other Subdivisions that are in near proximity to the planned development(s) are collecting signatures in opposition as well.

We respectfully ask that each of you keep the concerns and requests of the constituents and Citizens of The City of Beaumont and Jefferson County in consideration when discussing any advancement of Multi-Family Zoning that may or shall come before a City Council Meeting either Public or Private.

As our elected representatives and management of The City of Beaumont and Jefferson County we thank you in advance for your individual and collective support in our efforts in which we oppose any Zoning Change to Multi-Family Zoning on North Major Drive between Delaware and Folsom

Kindest Regards,

The Residences of Fairfield Subdivision

It has been brought to our attention that developers have expressed a desire to build multi-family units along Major Drive.

If you do not want multi-family zoning in our neighborhood then is very important that you let your voice be heard. Please contact our Mayor, each member of the City Council, the Community Development Director, and the Planning Manager to voice your opposition.

You may ask yourselves what more can you do once you have emailed and/or called our Mayor and our City Council Members?  A critical proactive step would be for you to attend the Planning and Zoning meeting once the rezoning, for the tract of land has applied for rezoning and placed on the agenda for public comment. We will notify our residents as soon as we know when it is placed on the agenda in hopes to have a strong representation of those who are in opposition to the rezoning.  Here is a link to the Planning and Zoning schedule:  http://www.cityofbeaumont.com/PDF/PZ.pdf

On Saturday, February 2 at 10am, 12pm, 2pm, 4pm, and 6pm, or until finished Fairfield residents will be canvasing our neighborhood to obtain signatures of those residents whom are in opposition to the multi-family rezoning of the properties in the proximity to our neighborhood.  The petition shall read as follows:

We the citizens of Westchase Village, Fairfield, and Barrington Subdivisions as well as
property owners in the immediate area hereby state that we adamantly oppose
the rezoning to multifamily residential on any land on Major Drive
between Delaware and Folsom.  There is already multifamily residential south of
Delaware and north of Folsom.  We are open to GCMD2 (General Comercial Medium Density) with specific use permit.

Thank you,
Fairfield HOA Board
